Outgrown — Terms of Service

Welcome to Outgrown. Please read these Terms of Service ("Terms") carefully before using our service. By creating an account or using Outgrown, you agree to these Terms.
1. Who we are
Outgrown ("Outgrown," "we," "us," or "our") is a community platform that helps parents pass on children's clothing, toys, and gear that their children have outgrown, to other families who need them.
The service is currently operated by Michael LaMaina, an individual ("the Operator"). The Operator intends to transfer operation of Outgrown to a Delaware limited liability company. Upon that transfer, the term "Operator" in these Terms will refer to that company, and your continued use of Outgrown will be governed by these Terms as operated by that successor entity. We will update these Terms to reflect the change in operator when it occurs.

2. What Outgrown is — and what it is not
Outgrown is a platform that connects parents with one another so they can give and receive second-hand children's items. It is built around a simple idea: what your child outgrew, another child needs.
Outgrown is a gift economy. Items on Outgrown are given freely between families. No money is exchanged for items through Outgrown, and selling items is not permitted. Outgrown is not a marketplace, a shop, or a reseller.
Important — please read this carefully:
- Outgrown does not own, sell, supply, inspect, test, store, ship, deliver, or take possession of any item listed on the platform.
- Outgrown is not a party to any arrangement, exchange, or hand-off between users. All such arrangements are made directly between users, at their own discretion and risk.
- Outgrown does not verify the safety, quality, condition, authenticity, legality, or suitability of any item.
- Outgrown does not guarantee that any user is who they claim to be, that any item will be handed over, or that any hand-off will take place as arranged.
Outgrown simply provides the tools that let parents find one another and communicate. Everything that happens between users — including meeting in person and handing over items — is between those users alone.
3. Eligibility
To use Outgrown, you must:
- Be at least 18 years old;
- Be a parent, guardian, or caregiver, or otherwise have a legitimate reason to give or receive children's items;
- Be capable of entering into a binding agreement under the laws that apply to you;
- Provide accurate information when you register and keep it up to date.
Outgrown is not intended for use by anyone under 18, and we do not knowingly allow minors to create accounts. Outgrown is intended for adults arranging items on behalf of children — not for children themselves.
4. Your account
When you create an account, you are responsible for:
- Keeping your password and login details confidential;
- All activity that happens under your account;
- Notifying us promptly at hello@getoutgrown.com if you believe your account has been used without your permission.
You must verify your email address before you can claim items. You may not create accounts using false information, impersonate anyone, or create multiple accounts to evade limits or restrictions.
We may suspend or close your account if you breach these Terms, misuse the platform, or behave in a way that harms other users or the community.
5. Listing items
When you list an item on Outgrown, you confirm that:
- The item is yours to give away, and you have the right to give it;
- You are giving it freely, with no expectation of payment or anything in return;
- The description, photos, and details you provide are honest and accurate;
- To the best of your knowledge, the item is safe and suitable for its intended use, and is not subject to a safety recall;
- The item is legal to give away and does not infringe anyone's rights.
You may not list:
- Anything offered for sale, barter, or payment of any kind;
- Recalled, unsafe, broken, contaminated, or hazardous items;
- Counterfeit goods;
- Anything illegal to own or transfer;
- Anything that is not genuinely a children's item passed on in the spirit of the community;
- Items containing personal data (e.g. a device that has not been wiped).
Certain second-hand children's items carry inherent safety considerations — for example, car seats (which may have been in an accident or expired), cribs and sleep products, and helmets. You are responsible for understanding and disclosing anything relevant to the safety of an item you give away. Outgrown does not assess these things for you.
Once another user's claim on your listing has been accepted, you may no longer change the item's key details. This protects the parent who is relying on your listing.
6. Claiming items
When you claim an item, you understand that:
- A claim is a request, not a guarantee. The person giving the item decides whether to accept it;
- The item is offered as-is, with no warranties of any kind (see Section 9);
- It is your responsibility to inspect any item before relying on it, and to decide whether it is safe and suitable for your child;
- Outgrown has not checked the item and makes no promises about it.
Free accounts may be limited in how many items they can claim within a given period. Details of any such limits, and of any optional paid features, are described in the app.
7. Meeting and handing over items — safety
Outgrown is built around local, in-person hand-offs between families. This is part of what makes it work — but it also means you will arrange to meet other people.
You are solely responsible for your own safety and the safety of your family when arranging and carrying out any hand-off. We strongly encourage you to:
- Meet in a public place where possible;
- Use your own judgment about whom you meet and where;
- Inspect items in person before accepting them;
- Never feel obligated to complete a hand-off you are not comfortable with.
Outgrown is not responsible for the conduct of any user, online or in person, and is not responsible for any interaction, meeting, or hand-off between users. We do not conduct background checks on users.
8. Community conduct
Outgrown only works if people treat each other with the same goodwill that the platform is built on. You agree that you will not:
- Use Outgrown to sell, advertise, or solicit payment;
- Harass, threaten, deceive, or abuse other users;
- Post false, misleading, offensive, or harmful content;
- Collect or misuse other users' personal information;
- Use the platform for any unlawful purpose;
- Attempt to disrupt, hack, scrape, overload, or interfere with the platform or its security;
- Use bots or automated means to access the service without our permission.
We may remove content and suspend or remove users who breach these rules.
9. No warranties
Outgrown is provided "as is" and "as available." To the fullest extent permitted by applicable law:
- We make no warranties or guarantees of any kind about the platform, its availability, or its reliability;
- We make no warranties whatsoever about any item listed, claimed, or handed over — including its safety, quality, condition, authenticity, legality, or fitness for any purpose;
- We do not warrant the identity, conduct, or trustworthiness of any user.
Any item you obtain through Outgrown, you obtain at your own risk.
Nothing in these Terms excludes or limits any rights you have that cannot be excluded or limited under applicable law.
10. Limitation of liability
To the fullest extent permitted by applicable law:
- The Operator will not be liable for any loss, injury, damage, or harm of any kind arising out of or connected with: any item given or received through Outgrown; any interaction, meeting, or hand-off between users; the conduct of any user; or your use of, or inability to use, the platform.
- This includes, without limitation, any personal injury, property damage, illness, or harm to any person (including any child) connected with an item or a hand-off.
- The Operator will not be liable for any indirect, incidental, special, consequential, or punitive damages.
Because Outgrown is currently provided free of charge and operates as a community gift economy, you acknowledge that it would not be reasonable to hold the Operator liable for the independent actions of users or the condition of items the Operator has never seen.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Where liability cannot lawfully be excluded, it is limited to the minimum extent permitted by law.
11. Indemnity
You agree to indemnify and hold harmless the Operator from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of: your use of Outgrown; any item you give or receive; any hand-off or interaction with another user; your breach of these Terms; or your violation of any law or the rights of another person.
12. Content you provide
You keep ownership of the photos, descriptions, and other content you post. By posting it, you grant the Operator a non-exclusive, worldwide, royalty-free licence to host, display, and use that content for the purpose of operating and promoting Outgrown. This licence ends when you delete the content or your account, except where the content has already been shared with another user or where we must keep it to comply with the law.
You are responsible for your content and confirm you have the right to post it.
13. Paid features
Outgrown may offer optional paid features (for example, the ability to claim more items than the free tier allows). If and when paid features are offered:
- Their price, billing terms, and what they include will be clearly described at the point of purchase;
- Payments will be handled by a third-party payment processor; we do not store your full payment-card details;
- Your statutory rights as a consumer, including any right of withdrawal that applies to you, will be respected.
These Terms will be updated with full paid-feature terms before any charges are made.
14. Privacy
Your privacy matters. Our Privacy Policy explains what personal data we collect, why, and what rights you have. By using Outgrown you also agree to our Privacy Policy.
15. Changes to the service and to these Terms
Outgrown is new and evolving. We may change, add, or remove features, and we may update these Terms from time to time. If we make a material change to these Terms, we will take reasonable steps to let you know (for example, by email or a notice in the app). Your continued use of Outgrown after a change means you accept the updated Terms. If you do not agree, you should stop using Outgrown and may close your account.
16. Ending your use
You may stop using Outgrown and close your account at any time. We may suspend or end your access if you breach these Terms or misuse the platform. Sections that by their nature should survive termination — including Sections 9, 10, 11, and 17 — will continue to apply.
17. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence give you additional rights that cannot be overridden by contract.
If you are a consumer resident in the European Union, nothing in these Terms deprives you of the protection of the mandatory consumer-protection rules of the country where you live, and you may be entitled to bring proceedings in your local courts. The European Commission also provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

18. General
- If any part of these Terms is found unenforceable, the rest remains in effect.
- These Terms are the entire agreement between you and the Operator regarding Outgrown.
- Our not enforcing a right at any time does not waive that right.
- You may not transfer your rights under these Terms; the Operator may transfer its rights and obligations to a successor entity (such as the Delaware company described in Section 1).
